Cloud-based technologies have become the new norm. But what are the data protection implications of such projects relying on this technology? This question is specifically relevant given the entry into force, on September 1, 2023, of the new Swiss Data Protection Act, which significantly increases the data protection obligations. This legislative overhaul, combined with the restrictive position taken so far by the Swiss Data Protection Authority, creates a challenging environment for the implementation of cloud-based IT solutions, even though the industry trend is clearly moving into this direction.
